ASSESSMENT LIENS & EXERCISE POWER OF SALE

RECORD "NOTICE OF CLAIM OF LIEN-HOMEOWNERS ASSESSMENT":
Mail Certified Mail-Return Receipt Requested and First Class with postage prepaid, to property address and any other addresses furnished by the Homeowners Association.  Owner (s) is given 30* days to cure** the Lien, (unless CC&R's specify a longer period), and advised in this mailing after the 30* days a Notice of Default and Election to Sell will be recorded in the office of the County Recorder of Clark County, State of Nevada.

AFTER THE 30* DAYS we will call the Homeowners Association or Agent and ask them if  they would like us to proceed with the Notice of Default and Election to Sell.  We then prepare the document for signature by the Homeowners Association or Agent.

RECORD "NOTICE OF DEFAULT AND ELECTION TO SELL" AND REQUEST TRUSTEE'S SALE GUARANTEE:  At the time we record the Notice of Default we request a Trustee's Sale Guarantee Report from the Title Company, which also gives us the correct information for our mailing (Certified Mail-Return Receipt Requested and First Class with postage prepaid), notifying the Owner(s) when the ninety (90) day redemption period will expire.

TWO WEEKS PRIOR to the expiration of the NINETY (90) DAY REDEMPTION, we will contact the Homeowners Association or Agent for written Authorization to Publish, and the approximate balance of fees through Sale.  As you know, these fees are immediately returned to your Association at Cure or at Sale if purchased at Public Auction.  We are then ready to publish when the Ninety (90) day redemption period expires.  We publish for three consecutive weeks (one day a week), and hold the Sale in the fourth week.  On the first day of publication we post and mail Registered Mail-Return Receipt Requested and First Class with postage prepaid to the mailing list furnished on the Trustee's Sale Guarantee, and all other known addresses.

TWO WEEKS PRIOR TO SALE we prepare the Homeowners Association Demand and Bid Statement, Affidavit of Non-Military Service, and Authorization to Change Bid Statement for the Homeowners Association or Agent to sign, and attach a copy of the Notice of Condominium/Townhouse Homeowners Association's Sale of Condominium/ Townhouse Unit.

SALE will be held at 1pm. the FRONT ENTRANCE OF THE NEVADA LEGAL NEWS, located at 930 South Fourth Street, Las Vegas, Nevada  89101.

THE FAIR DEBT COLLECTION PRACTICES ACT (see attached).  The "Full-Miranda" will be included with all written communications between Homeowner Association Services, Inc. and the delinquent owner(s).

CURES - we like to handle the cures in our office through our Trust Account, which also insures the collection of Agent fees so that there is no expense passed on to the Homeowners Association.  We then prepare the RELEASE OF CLAIM OF LIEN and/or NOTICE OF RESCISSION OF NOTICE OF DEFAULT AND ELECTION TO SELL for the Homeowners Association or Agent to sign for recording.
